Hi, I saw you resolved a contest issue for this guy, http://www.vidopp.com/when-a-contest-goes-south/ , so I thought maybe you could help me out. I entered this contest originally in January. The original deadline was January 15th and we got ours in before that date. As you know they extended the deadline to February 15th to allow for more entries. They said they would allow youtube voting until march 30th. I emailed them April 2nd and they said “We are in the process of judging. All participants should receive a message by the 15th to let them know where they placed.” After waiting a while, without notice they delayed the contest deadline AGAIN until June 30th. When I emailed them about it again I received this response “Thank you for your comments. We understand your concerns and it was not an easy decision for the very reasons you mentioned. We apologize for the unfortunate circumstances, but we want you to know that we appreciate your patience and your interest. ” So while I was a little upset, I waited patiently until the 30th of June which means that the contest was delayed almost 6 months. They finally changed their website to have people vote for it. Originally the Top 10 finalists were to receive “Nice Packages” for their crew (up to 5 people) and the winner to receive $1000. As of now, they have removed the 10 finalist prizes from the rules and only have the $1000 prize. At every single ending of the judging that they have had, our video has been in 1st place with the number of views as well as star rating, with it being at 4.5/5 stars for the entire time until a few weeks ago when we got 20 random votes that knocked our rating down a notch. Nevertheless, we are still ranked first. As if the un-announced winner problem isn’t enough, in our video we came up with the idea of Schwetty Balls-Blue Ball Edition, as part of our mock ad. This was in January when we submitted it, and I wrote the actual sketch in December. While waiting this spring for the winners to be announced, we found out that Schwetty Balls had gone and created Schwetty Balls-Blue Ball Edition and are marketing them. If you don’t believe me, look at their website on the FRONT PAGE. www.schwettyballs.com . That came out this late spring/early summer, when we had submitted our video almost 5 months prior. While I know they can use my video if I submit it, I did not know if they have a right to steal my idea and market it.
I’ve talked to many of the other entrants and they’re all as frustrated as I am with the lack of communication that Schwetty has given us. I’ve made submissions in other contests and none have been this frustrating. I really appreciate this website and I was wondering if you could help us out at all. Thanks so much.

P.S. Seeing as it has been over a month since the “official” contest deadline, I sent an email today to Schwetty asking if they would announce the winner, but I have not received a response as of yet.

Hi Joel,
I will contact the sponsors and do what I can. When dealing with a highly reputable and professional group like OurStage we can hope for a happy ending. Let’s hope that the Schwetty guys have integrity as well. I’ll keep you in the loop.
Regards,
Douglas

Joel, I contacted DW Sports Group, the sponsor of the Schwetty Balls contest, and here is what I was told:
Please keep us in the loop on this to ensure there is a satisfactory resolution.
Best regards,
Douglas at VidOpp.com

I’ve also been waiting for them to announce the winner.
…I’m a little disappointed. I do hope they follow OurStage’s excellent example.

They finally announced a winner.
Still a little unsatisfied, as I personally would not have picked said winner, but at least they picked SOMEBODY.
I was wondering though, if there was anything we could do about the fact that they took our new albeit, at-the-time-fictional, product and actually are taking it to market and selling it without any type of compensation to my partner and I? Is that even legal? I don’t know what avenue I can take as a small, amateur film maker, but its very discouraging whenever someone takes a creative idea and doesn’t cite, recognize, or compensate you in any manner. Let me know if there is anything you can do or anything you would recommend to me.

Joel: That’s pretty lame they used your idea and didn’t credit you.
Personally I’m frustrated that the winner posted his entry in mid-June, whereas the people who worked hard to honor the original deadlines got nothing out of it. Hence why I strongly dislike companies who extend deadlines. Honor your word.
Another thing that bothers me is that the winning video had blatant copyright violations. Schwetty balls should have thought twice about choosing a winning video with Nike products in it.

Hi Joel,
I reached out to them, and talked to them about their new product. Here is their response:
Blue balls were in the works for quite some time. We were just waiting for Father’s Day to release the new product.
Sorry, but it looks like they have no intention of rewarding you. Guess it is time to move on to the next opportunity.
Regards,
Douglas

I know they were in the works for some time. They introduced it for fathers day. I put the video up only 6 months earlier. I’m sure that was enough time for them. Psh.
Thanks for the help Douglas. I’m sorry I sound bitter. I just don’t like companies who think they can do whatever they want, especially when it involves stealing my ideas.
I appreciate everything you guys do on the website. keep it up and I hope to be participating more in the future.
